Ujjain : The Lok Ayukta police filed FIR against SDM Shailendra Singh Solanki, the then general manager (GM) of District Industry and Commerce Centre, the then Additional Collector Satyendra and Virendra Khandelwal for selling government land of ginning factory illegally. Lok Ayukta Ujjain unit Inspector Basant Srivastava will investigate the case.
Agricultural land survey number 1729/1 raqba 2.801, which is under the possession of government, came under the possession of Gwalior State earlier. Jagirdar Chhatar Singh on behalf of Gwalior State gave the land on lease to the then owners of Malwa Cotton Press for establishing a ginning factory in 1907. A condition was mentioned in the lease document that the land will be handed over to the government in case of nonfunctioning of the factory or the closure of the unit. The then collector of Ujjain had issued the orders for the eviction of Satyendra and Virendra Khandelwal, heirs of lease holder Vishambar Dayal on April 5, 1981 after the factory was closed. The lease was also cancelled. Satyendra and Virendra filed an appeal before the additional revenue commission of Ujjain against the orders of the then collector. The appeal was cancelled on April 24, 1981.
The duo filed a second appeal with the Revenue Board department, Gwalior in which the board has declared them owners of the land and issued an order on September 6, 1983. The board issued the order by going beyond their jurisdiction while the right of declaratory help is given only to the Civil Court. The then Additional Collector of Ujjain declared Satyendra and Virendra Khandelwal as the owners of the land as per the orders of the Board. Law and Legislative Affairs department, Bhopal had issued orders to the SDM for appealing against the orders of the Court of Revenue Board Gwalior on July 29, 2013. Indore Additional Advocate General also advised him to file an appeal on January 9, 2013. During investigation, it was found that the land is of the ginning factory and the Revenue Board Gwalior does not have right to take decision in the matter. SDM Shailendra Singh Solanki did not consider the matter till date.
Directorate of Industry, Land Acquisition Cell Bhopal had issued orders to the Industry Commissioner Bhopal and District Industry & Commerce Centre to occupy the land on September 29, 1988, but the then GM of District Industry & Commerce Centre did not take possession of the land. The land is located at the centre of the city and worth rupees crores. Satyendra and Virendra Khandelwal in collusion with officials sold a part of the land to Anushka Tradelink Pvt Ltd director Kishore, son of Mohanlal Chhabra, and Ishwar, son of Jayram Patel, for Rs 2,53,92,000 on December 20, 2011. Lok Ayukta police took the entire matter into the acknowledgement for selling the government land and lodged FIR against SDM Shailendra Singh Solanki, the then General Manager (GM) of District Industry and Commerce Centre, the then Additional Collector, Satyendra and Virendra Khandelwal.
