HC tells school to readmit student with cancer, refund fee

Indore : A five-year-old girl suffering from cancer was shown the door by her school as she gave a miss to classes for treatment and her parents requested for fee waiver for the period she remained absent.

Irked over behavior of Choithram School, Bhavya’s parents moved a petition in the Indore bench of Madhya Pradesh High Court which directed the school to re-admit the child and waive off her fee for the period when she was absent for treatment. The court also directed the school authorities to file a compliance report within a week.

Petitioner’s counsel Advocate Vishal Sanothiya said that the court directed the school to give special treatment to Bhavya and not mount any kind of pressure related to academics or other activities on her. Sanothiya also stated that the court observed that the schools should be sympathetic towards children suffering from serious

diseases and should be more concerned about the health of the children than their fee. Justice SC Sharma who passed over in the case said that the school should not hound parents of the ailing child during their time of pain.

Bhavya was diagnosed with cancer last year and her parent took her to Tata Memorial Hospital in Mumbai for treatment. As she was admitted at the hospital for treatment, Bhavya could not take classes even as the school built up pressure on her parents to pay the tuition fee.

“When Bhavya’s parents informed the school about her illness and sought fee waiver so that they spend more on her treatment. But to their shock, the school cancelled her admission prompting them to move the court,” Sanothiya said.
