New Delhi : Swan Telecom Promoter Shahid Balwa, facing trial along with former Telecom Minister A Raja and 15 others in the 2G spectrum allocation scam case, on Monday argued in a special court that there were several contradictions in prosecution’s story which defy the existence of conspiracy.
Advancing final arguments on behalf of Balwa, his counsel alleged before special judge O P Saini that the CBI has made those persons accused in the case who have not toed its line.
“The silence of the prosecution in providing answer to important questions is in itself the answer. This silence establishes the fact that there was no conspiracy as alleged or at all and things were happening within the Department of Telecommunication (DOT) in the usual course of business, which have now been artificially shown to stand out by showing only Shahid Balwa made-up episode and hiding investigation about others, despite directive of CVC, reports PTI.
“This only shows that people who have not toed the lines of the prosecution have been made accused. This could be the only answer,” advocate Vijay Aggarwal, who was appearing for Balwa, argued.
Earlier, Raja had claimed that there was no evidence to show he was aware of the Rs 200 crore transaction between DMK-run Kalaignar TV and DB Group firm.
He had said the agency has alleged that Rs 200 crore was bribe which was paid to the DMK-run TV channel in return of 2G licence granted to Swan Telecom Pvt Ltd (STPL) but CBI has failed to produce any evidence that he had helped in any way in the transaction. Besides Raja and Balwa, DMK MP Kanimozhi, former Telecom Secretary Siddharth Behura, Raja’s erstwhile private secretary R K Chandolia, Unitech Ltd Managing Director Sanjay Chandra, STPL promoter Vinod Goenka and three executives of Reliance ADAG – Gautam Doshi, Surendra Pipara and Hari Nair – are facing trial in the case.
