Mumbai: A sessions court in Dindoshi at the end of May granted bail to a 33-year-old auto driver accused of exposing his private part to two teenage girls and thereby sexually harassing them, stating that prima facie no actual physical assault was caused to the victims.
The court stated in its order that the record prima facie makes it clear that no actual physical assault was caused to the victims by the applicant. It also considered that the chargesheet had been filed in the case and that the person had been in custody since mid-March while granting the relief.
The man had claimed to be falsely implicated due to enmity with the father of the teenagers. The Malad police station where the crime was registered against him, had opposed his bail plea stating that he had deliberately followed the minors and harassed them repeatedly by unzipping his pants. It had also pointed out that he was caught from the spot as they had dialed 100.
As per the complaint filed against him, he had started singing loudly to attract their attention and then unzipped his pants and exposed his private part to the girls.
The man had been booked under IPC Sections 354A (sexual harassment), 354D (stalking), 509 (word, gesture or act intended to insult modesty of woman) and under provisions of the POCSO Act pertaining to sexual assault and sexual harassment.
