Mumbai : The recent decision of regularising services of non NET/SET teachers from next week by the state government is clear violation of University Grants Commission (UGC) decision. The UGC has directed that teachers should be confirmed in service from the date of their joining.
The state government on Wednesday decided to confirm services of more than 2500 teachers who were appointed between September 19, 1991 to April 3, 2000. But the government announced that services will be confirmed after the government resolution was issued – most probably in the next week. This was gross violation of UGC’s order on August 26, 2011. ” The services of such teachers for all purposes should be counted from the date of their regular appointment,” UGC in its order signed by B K Singh and sent to Principal Secretary, Higher and Technical Education, said. This order was issued by UGC after a legal battle fought by lecturer T D Kose against state government. Kose who works as a lecturer of Chemistry at a college in Chandrapur filed a petition on this issue in 2010 at Nagpur Bench of Bombay High Court. ” During hearing, state government should take a stand that if UGC permits us, we have no objection to confirming the services. As 80 per cent component of lecturer’s salary comes from the UGC, the state made it clear that it would be bound by whatever stand is taken by UGC on the issue,” Kose told FPJ. The State even washed off its hands and asked the petitioner to get the clarification from UGC. Taking serious view of this, the High Court has directed the UGC to clear its stand in three weeks. As per this order, the UGC conveyed their stand to the state government. High court also directed state government to reconsider the cases of teachers in accordance with the law and procedure.
” Few affected teachers have already retired and others have completed their services for at least two decades and now government is saying that their service will be counted from this year. In last twenty years, they are working in same pay band which is almost half of what a regular lecturer could have got, ” Kose alleged.
