Indore : The Indore-bench of Madhya Pradesh High Court on Tuesday asked sitting BJP MP Chintaman Malviya of Ujjain to pay a fine of Rs 3,000 to his predecessor, Premchand Guddu of the Congress for non appearance in the court.
The court also ordered the Registrar of Indore bench to file a criminal case against the BJP MP under Section 340, for presenting a false affidavit before the court, and ordered an inquiry with regards to the affidavit that was submitted in the court by Malviya.
The case would be presented in the court of Judicial Magistrate. It is to be noted that former Congress MP Premchand Guddu had filed a case of providing false information to the election officer during the Lok Sabha elections, for which the court served notices to all the respondents on September 1, 2014.
It is claimed that the notice was served on him through his employee who was in Ujjain, but the BJP MP was attending the parliamentary session in New Delhi.
It is claimed that on receiving the notice, Malviya immediately filed the application on January 29, 2015 and prayed to the court that he be permitted to join the House proceedings.
However, the counsel of Guddu said that Malviya himself received the notice and gave a misleading and false averment in the application and on the affidavit, thereby asking a case to be registered under Section 340 CrPC.
