A man filed a petition of quashing FIR against him in a kidnapping case but Bombay High Court denied his plea. The court told him that the FIR will be repressed only after he marries the minor girl with whom he eloped in 2018.
The 19-year-old man was in a relationship with the 17-year-old girl hailing from Dongri. Both of them eloped in 2018. Later, the boy refused to marry her. A case of kidnapping was then registered against the boy. He was booked under relevant sections of IPC and the Prevention of Children from Sexual Offences (POCSO) Act.
Later the man agreed to marry the girl and signed an agreement proposing that he will marry her once she turns 18. An agreement of marriage (Kabin Nama) was executed by the man in October 2018 for this purpose. The man has agreed to marry the girl after she turns 18 in August 2019.
The man’s advocate informed about the same to the Court and filed a petition to quash FIR against him. The girl and her mother also agreed for quashing of FIR but Court maintained that FIR will be revoked only after he marries the girl.
