Mumbai : The Kurla metropolitan court yesterday deferred Janhavi Gadkar bail application till Fri-day. Public prosecutor Pramod Mahajan held that in light of the ongoing investigations, it would seem fit to not grant bail to the accused. Citing the Alist-air Pereira and Sanjeev Nanda cases, Mahajan reasoned that denying bail would seem like the most cautious course of action. This sparked off an arg-ument between the Gadkar’s counsel Amit Desai and Maha-jan. Desai brought it to the court’s notice that Gadkar’s example of tampering of evid-ence that followed Sanjeev Nanda’s bail order had defama-tory implications. Desai, who has also represented Salman Khan in the hit and run case, challenged the prosecutor’s speculation saying that both the aforementioned cases diff-ered severely from the case in hand. In Gadkar’s case, the defense maintains in her bail plea that it is not a case of culpable homicide not amou-nting to murder under Section 304 (II) of IPC but only a case of a rash driving.
