Mumbai Sessions Court Grants Anticipatory Bail To Navi Mumbai Teacher In Special Child Assault Case, Cites Delay In FIR

A Mumbai sessions court granted anticipatory bail to a Navi Mumbai teacher accused of assaulting a specially-abled child. The court cited a 10-day delay in filing the complaint and noted strained relations with the school, raising the possibility of false implication.

Mumbai, April 1: The Sessions Court has on Wednesday granted anticipatory bail to a 55-year-old teacher from Navi Mumbai, booked for assaulting a specially abled child having 75% disability, after considering that the relation between the teacher and the school is strained.

Case and allegations

School teacher Prashant Kishor Garge was booked by Tilak Nagar Police Station on February 10, on the complaint of the parents of the special child studying in Sulabha School for mentally retarded children at Tilak Nagar.

The parents had alleged that on January 30, Garge assaulted one of the students. Due to the said assault, the son of the informant was feeling body pain and pain in the left ear. The son of the informant was taken to a hospital for treatment at a private hospital.

On February 2, the parents approached the principal of the school. The parents, on the instructions of the principal, submitted a written complaint on February 3.

It is alleged that a few days later, the parents were called by the principal and thereafter a complaint was lodged with the police.

Defence arguments

Garge, while seeking anticipatory bail, claimed that he has been falsely implicated in the case. It is contended that nowhere in the complaint has the intention behind the alleged assault on the child been mentioned.

It was contended that the prosecution is initiated against the teacher with malafide intention to harass him on the count that the applicant initiated a legal proceeding against the management of the school before the High Court for the purpose of back wages.

Court observations

The court, after hearing both sides, noted that “The report of the incident came to be lodged with the police station on 10.2.2026 with almost a delay of 10 days. Lodging of a report with a delay of 10 days creates a possibility of false implication on due deliberation.”

Besides, the court noted that the teacher was terminated by the school in May 2007. He had challenged the termination, wherein the court had ordered the school to reinstate him in August 2016.

The court noted that the order shows that “The material goes to show that the relation between the applicant/accused and the school authority is strained, which is required to be noted,” the court said while granting anticipatory bail to the teacher.
