Mumbai, April 1: The Sessions Court on Wednesday granted bail to three accused booked in connection with the fatal Metro Line 4 parapet collapse in Mulund, noting that the incident had taken place due to error of the welder.

Incident and case details

A portion of a concrete parapet collapsed onto moving traffic on February 14, leaving one person dead and three others seriously injured in Mulund. Following the incident, police registered a case under provisions of the Bharatiya Nyaya Sanhita for culpable homicide not amounting to murder, mischief causing damage, and acts done by several persons in furtherance of common intention.

Accused and arrests

The three accused who had been granted bail are Harish Chauhan, Project Director; Kuldip Sapkal, Project Manager; and Avadhut Inamdar, Project Manager of D. B. Hill SBG company. Chauhan was arrested on February 14, while Inamdar was arrested on February 20, and Sapkal was arrested on March 4.

Defence arguments

Their advocates Suvarna Vast and Prahlad Paranjape sought bail on the ground that the welder, Ramashish Yadav, was specifically instructed by the supervisor to cut the hooks of the parapet whose concretisation had been done, and he was further specifically instructed not to touch the hooks of the precast parapet in the corner.

They argued that despite having specific instructions not to touch the hooks of the precast parapet, Yadav cut the hook of the precast parapet, due to which the precast parapet fell on the road below, on the auto-rickshaw and the car, causing the serious accident.

Prosecution stance

The plea was opposed by the prosecution on the ground that it was the responsibility of all the accused to look after the basic safety and security measures to avoid any such accident causing injuries to people. However, adequate safety measures were not adopted, the prosecution said.

Court observations

The court, however, noted that the accident occurred suddenly. The incident took place due to the welder. The court hence granted bail to the three, holding that further detention of the three is no more needed and the investigating officer can continue the probe even when the accused are released on bail.
