Mumbai: The special POCSO court on Tuesday granted bail to Bipasha Kumar, former teacher of Bombay Bombay Scottish School, arrested for sexually assaulting a student for nearly a year.
Kumar, however, will take a day or two to come out of the prison as his lawyer Neeraj Yadav will have to finish formalities to submit surety and personal bond of Rs 50,000.
Bail Granted with Conditions
The special court, has while granting her bail, imposed several conditions on her. One of the conditions is that she should not meet the victim or contact him by any ways. The detailed order however, was not available till evening and may be released subsequently.
Victim's Complaint Details Prolonged Abuse
Kumar was arrested on the complaint of the boy with Dadar police station that the lady had been sexually assaulting her for a year. He had claimed that the teacher was attracted to him and persuaded him to get into a relationship with him.
It is alleged that she first took the student in her car to an isolated spot, asked him to undress and had sex. She then used to take him to different five-star hotels and forcibly have sex with him after serving liquor over the past one year.
Teacher Blames Victim’s Parents for FIR
The teacher, in her bail plea claimed that the case is lodged at the instance of his parents as they were against their relationship. Her lawyer had referred to all the emails and messages sent by the boy to her wherein the boy had gone ahead and referred the teacher as his wife.
The woman in her plea has claimed that the case has been filed at the instance of victim’s mother, who knew about their relationship and was against it. It is claimed that the complainant was filed only few months before the boy was to turn 18 years old. She has claimed that the case is filed with ulterior motive, which can be gathered from the conduct of the boy.
The woman also claimed that the family has suppressed many of the facts intentionally to frame her only because the boy's parents were against their relationship.
Prosecution Opposes Bail, Highlights Minor Status
The plea was however opposed by the prosecution on the ground that there cannot be a consensual relationship as the boy was a minor and she was his teacher. Meanwhile, the boy had submitted his say in a sealed envelope, wherein he had objected to the teacher's plea. The court however, ruled out the objections and granted bail to teacher.
