Dr. Tadvi Suicide Case Moved To Bombay High Court Challenging SC/ST Ruling

Dr Yi Ching Ling, head of the gynaecology and obstetrics department at BYL Nair Hospital, has moved the Bombay High Court challenging the order of the special SC/ST court, wherein she has been added as an accused in the Dr Payal Tadvi suicide case.

Dr Ling is accused of not heeding to complaints against the charge-sheeted accused doctors. On Thursday, the senior doctor skipped the special court hearing, with her lawyer Ashish Chavan seeking an exemption citing gastro complications. Meanwhile, Tadvi’s family filed a plea seeking Dr Ling’s judicial custody, arguing that there is prima facie evidence against the newly added accused.

In response to the plea, Chavan stated that he would submit a detailed reply. He also opposed the family’s request, maintaining that Dr Ling should not be taken into custody. Dr Ling’s petition before the HC claims that the special court was not justified in adding her as an accused. It argues that, under the law, a court can order a person to be added as an accused only after evaluating witness testimonies during the trial. The petition adds that the actual trial in the case has not yet begun.
