OUR STAFF REPORTER Indore Justice NK Modi of Indore bench has directed Principal Secretary ( Industries) to appear before the court on Thursday with relevant documents in the matter of Yeshwant Club.
It may be recalled that former
treasurer of Yeshwant Club had filed a petition in the MP High court challenging his removal from the post of the treasurer by the governing body of the club. The court then passed a judgement in favour of Bajaj.
However, w hen Bajaj went to the governing body of the club armed with the court verdict for his reinstatement, the governing body had rejected his request on the grounds that the court has not specifically mentioned his reinstatement.
Aggrieved Bajaj once again filed another petition with the court, w hich came up for hearing, on Tuesday.
During the hearing, go vernment advocate told the court that matter be held in abeyance because Principal Secretary ( Industries), MP Government has issued an order in respect of the issue being litigated.
The court directed that a copy of the said order be produced and postponed the hearing until 4pm. The matter was again called for hearing at 4pm by at which time the government advocate requested the court for a weeks time on the grounds that the order had been forwarded by the Principal Secretary ( Industries) for approval.
Lawyers for Bajaj strongly objected to the suggestion and stated that the matter was being delayed unduly for the last four months and interpretation of the court order by the governing body of the club and denying reinstatement to Bajaj tantamount to contempt of the court. The court agreed with the Bajajs contention and asked the government advocate to cite rules and regulations which require a Principal Secretary to forward an order for approval, which the government failed to do so.
In view of these facts, the court then directed Principal Secretary ( Industries), MP Government to appear in the court on Thursday with relevant documents in the matter.
