STAFF REPORTER MUMBAI The Bombay High Court on Monday granted interim relief to ACP Anil Mahabole, an accused in the case related to the raping of a housewife. The court observed that prima facie there is no case of rape.
According t
o the case, a housewife alleged that Mahabole visited her house and offered her sweets. After consuming them, she went unconscious and when she regained consciousness, Mahabole showed her an MMS clip of her in a compromising position.
She alleged that Mahabole blackmailed her and repeatedly raped her.
However, after a departmental enquiry, a FIR has been registered against Mahabole and he has been suspended from the service.
After the Session court denied him anticipatory bail plea, the ACP approached the High Court.
Appearing for Mahabole, Adocate Rohini Wagh argued, ” She used to send him over 25 messages every day, some of which were obscene. This is not the first time she has registered a case. Earlier, she had registered molestation cases against another police officer and a jeweller.” While acting on the bail plea, Justice A M Thipsay said, ” Prima facie it is not a case of rape. After looking at the police report, this court does not believe the allegation of rape. It seems that they had an illicit relation relationship.” Granting Mahabole interim bail on a surety of Rs 30,000, the court posted his application for final hearing to April 30, and directed him to appear before the investigating officer every day for questioning in the meantime.
The court observed that prima facie there is no case of rape.
