Mumbai: Sessions Court Sentences 48-Year-old Man To Life Imprisonment For Stabbing Brother-In-Law To Death Over Domestic Dispute

Mumbai: A sessions court has sentenced a 48-year-old man to life term for killing his brother-in-law as the victim confronted him for ill-treating his sister.

According to the prosecution, the incident took place on January 27, 2020, when the victim, Vinod Mokhara, along with his wife, brother Giridhar and the latter's spouse went to speak with the accused, Rajesh Boricha, for subjecting their sister to domestic violence.

The quartet first arrived at Boricha's house near Arthur Road, but they came to know that he was at a relative's home at Dhobighat. They then proceeded there and met the accused, leading to an altercation. Boricha's relative shooed them away, asking them not to fight in her house.

The moment they came on the road, the accused took out a knife, stabbed Vinod and fled, said the prosecution. The victim was rushed to a hospital, however, he died during the treatment in an hour, it added. Subsequently, Giridhar lodged a complaint at the Agripada police station and Boricha was arrested the next day.

In his defence, he claimed that the knife was actually brought by Giridhar, with the intent to assault him, but Vinod came in between. Rejecting the argument, the court observed that it was the accused who had brought the knife for stabbing the victim. Thus, the former had clear intention to commit murder or he had knowledge that the stabbing injuries would be fatal, the court noted.

It further said, “The accused had a grudge against Giridhar and Vinod as they were interfering in the matrimonial dispute between him and his wife. Hence, he had a strong motive to attack Vinod.” The act of the accused of dealing a blow below Vinod's chest clearly indicates that his intention was to commit murder, the court noted.
