Mumbai Sessions Court Denies Bail To 37-Year-Old Businessman In ₹97.68 Crore Fraud Case Involving Madhya Pradesh Senior Citizen

A sessions court has refused to grant bail to a city-based businessman, who has been booked for duping a 61-year-old from Madhya Pradesh of Rs 97.68 crore. Sudhanshumohan Dwivedi, 37, was charged for criminal breach of trust after the elderly businessman filed a complaint with the Bandra police that he fleeced him on the pretext of good returns on investment.

Mumbai: A sessions court has refused to grant bail to a city-based businessman, who has been booked for duping a 61-year-old from Madhya Pradesh of Rs 97.68 crore. Sudhanshumohan Dwivedi, 37, was charged for criminal breach of trust after the elderly businessman filed a complaint with the Bandra police that he fleeced him on the pretext of good returns on investment.

Dwivedi, who is currently in the custody of the Enforcement Directorate, had approached the court for bail, citing illegal detention. He alleged that he was detained on the morning of March 28 but produced before the magistrate court at 1pm on March 30.

Further, he claimed that the medical examination report of KB Bhabha Hospital wrongly reflects that the medical examination was done on March 29 at 9.59pm. Asserting that his rights have been violated, Dwivedi said that his time of arrest was falsely shown as 11pm on March 29.

The court, however, after referring to various documents noted, “The police papers and case reflects that the applicant along with his wife and another woman proceeded from Bhopal on March 28 for inquiry.” He even informed the local police station that he is going to Mumbai in his own car along with Mumbai crime branch inspector Sachin Puranik, the judge pointed out.

“As pointed out by the investigating officer, the applicant even booked a room in a Mumbai hotel online,” the court said, while refusing to accept Dwivedi's contentions of non-compliance of procedure and illegal arrest. In his bail plea, he argued that the matter is a civil dispute, which is already settled.

“Considering the material in the case diary, the accusations are prima facie well-founded at this stage of the investigation. Considering the gravity of charges and severity of the punishment, the applicant is not entitled for bail,” the court said.
