Aurangabad : The Aurangabad bench of the Bombay High Court has cancelled the 16-days interim bail granted to Shiv Sena MLA Sureshdada Jain in multi-crore Jalgaon Housing Scam on Monday.
The bench comprising Justices S S Shinde and T V Nalawade issued an order to this effect on hearing arguments of prosecution and defence. Hearing of the issue was held on August 1 last. Counsels of appellant namely Adv Praveen Chavan, Adv Satesh Talekar, Adv Prasanna Kutti and Adv A B Sayyed brought to the notice of the court that the bail application of Sureshdada Jain wasn’t filed as per the criminal codes. His earlier bail application is already pending with other bench the Aurangabad High Court. Hence, filing another application for the same demand is not only wrong but also unlawful move by the accused.
The panel of lawyers also informed the court that a Dulhe special court, Aurangabad High Court and the Supreme Court already have rejected his bail applications earlier. In addition, MLA Sureshdada Jain has provided false information to the court saying that he needed bail on medical grounds and for a housewarming function of his son, but he hasn’t provided necessary medical certificates and the name of the owner of the house. The Supreme Court has directed the concerned authorities to provide him medical treatment in jail. Keeping his behavior during the earlier bail, it would not be fair for investigation to grant him bail.
It may be noted that a Dhule special court had granted him 16-days interim bail on July 17, 2014. This order was challenged by a social worker Narendra Bhaskar Patil in High Court through a litigation.
