In the urgent Supreme Court hearing held on Wednesday evening, a vacation bench of Justices Surya Kant and Jamshed B Pardiwala refused to interfere with Governor BS Koshyari’s direction to the MVA government to prove its majority.
“We are not staying the floor test. We are issuing notice... you can
file a counter,” it said.
However, the floor test, against which the hearing was held, became infructuous when Uddhav Thackeray resigned from the post of
chief minister minutes after the order.
Right at the outset of the four-hour hearing which began on Wednesday evening at 5 pm, the Supreme Court affirmed that “floor test is the only way to settle the issues”, when the MVA counsel Abhishek Manu Singhvi said “heavens won’t fall if floor test does not take place on Thursday, but held on July 12”, the date fixed by the apex court for the dissident Shiv Sena Singhvi argued that the Governor cannot shortcircuit the Supreme Court’s proceedings or the Speaker’s disqualification proceedings.
Singhvi also argued that those who already stand disqualified on June 21 cannot be allowed to vote on Thursday. He urged the top court not to allow a situation that cuts at the root of democracy.
