Bombay HC Directs Defendants To File Replies In Deonar's Green Garden Apartments CHS TDR Fraud Case By April 4

The Bombay high Court on Tuesday asked the defendants to file replies in the plea by Green Garden Apartments CHS Ltd, Deonar, against its former chairman and several real estate developers, alleging a large-scale fraud involving Transferable Development Rights (TDR).

Mumbai: The Bombay high Court on Tuesday asked the defendants to file replies in the plea by Green Garden Apartments CHS Ltd, Deonar, against its former chairman and several real estate developers, alleging a large-scale fraud involving Transferable Development Rights (TDR).

It was pointed out to the court that some of the defendants were yet to file their reply affidavits to the plea.

Justice Arif Doctor asked the respondents to file the replies to the suit while asking to complete the pleadings in the matter. “Let all replies be filed within one week. Pleadings to be completed,,” Justice Doctor said, scheduling the matter for hearing on April 4.

The housing society filed a suit seeking a declaration that the agreements for the sale of TDR, purportedly executed by certain members without general body approval, are illegal and void. Additionally, it has demanded a refund of Rs16.51 crore allegedly paid unlawfully to two consultancy firms.

According to the suit, the Brihanmumbai Municipal Corporation (BMC) acquired 7,284.10 sq. meters of the society’s land in 1986 for road construction. As compensation, the society became entitled to TDR, which was formally granted in August 2023 through a Development Rights Certificate (DRC).
