Badlapur Sexual Assault Case: Bombay HC Censures Thane Sessions Court For Granting Partial Relief To 5 Cops Involved In Encounter

The Bombay High Court took a dim view of the sessions court keeping in abeyance observations against 5 policemen found responsible for the death of Badlapur sexual assault accused Akshay Shinde.

"It is overreaching orders passed by us. The judge overstepped his jurisdiction. When the matter is subsided before this court, whether FIR ought to be registered based on magistrate’s report, can the sessions judge entertain this revision application?" questioned the HC.

Notably, recently Thane Sessions Court granted partial relief to the policemen held accountable for the custodial death of Akshay Shinde, an accused in the Badlapur sexual assault case.

Earlier it was reported that the sessions court kept in “abeyance” two crucial paragraphs — 80 and 81 — of the magistrate’s inquiry report, which had named the officers and questioned the legitimacy of the alleged encounter.

The High Court received a magistrate's report on January 20 that determined the officers transporting Shinde from Taloja Prison to Kalyan were accountable for his death. The report specifically identified five officers: Senior Police Inspector Sanjay Shinde of the Thane Crime Branch, Assistant Police Inspector Nilesh More, Head Constables Abhijeet More and Harish Tawade, and Police Constable Satish Khatal.

The implicated officers contested these conclusions by filing a petition with the sessions court through their legal representatives Sayaji Nangre, Sameer Nangre, and Suraj Nangre. On February 21, the court provided temporary relief by suspending the disputed paragraphs pending further judicial review.
