Indore: Kakkad labels action as illegal in HC petition

Chief Minister Kamal Nath’s confidant Pravin Kakkad on Tuesday filed a petition with Indore Bench of Madhya Pradesh High Court to declare the Income Tax raid at his place as illegal. In his petition, Kakkad said that the I-T action against him was politically influenced and the press release issued by CBDT includes Indore’s name as well which defamed him. Kakkad also mentioned that the IT officials entered his house after breaking the door at 3.30 am on the intervening night of Saturday and Sunday and kept him and his family hostage for two days.

The initial hearing of the petition took place before the divisional bench of Justice SC Sharma and Justice Virendra Singh but the divisional bench directed to submit the petition in any other bench.  Immediately, the petitioner moved an application to Jabalpur appealing to constitute a special bench to hear the petition after which the High Court constituted a special bench and hearing took place before the bench of Justice Prakash Srivastava and Justice Vivek Rusiya.

Advocate Sumit Neema and Shashwat Seth were representing Kakkad in the court and CBDT chairman, Finance Secretary, Chief Election Commissioner, Director of Income Tax Department and DGP of Madhya Pradesh were the respondents. The court will hear the petition on April 11.
