New Delhi, August 6, 2026: The Supreme Court has taken serious note of the Lucknow coaching centre fire that claimed the lives of 15 students in June and issued a contempt notice to the Vice-Chairman of the Lucknow Development Authority (LDA) over alleged non-compliance with its directions.
The Court noted that the building where the tragedy occurred had continued to be used for commercial and educational activities despite being residential premises. The case has brought the enforcement of building and land-use regulations, and the accountability of public officials, under scrutiny, Live Law reported.
Demolition Order Recalled
During the hearing, a Bench of Justices Ahsanuddin Amanullah and R. Mahadevan was informed by Senior Advocate Ajit Kumar Sinha, the amicus curiae, that a demolition order concerning the building had been passed on May 10, 2016.
However, the authority that passed the demolition order recalled it on July 5, 2016, on technical grounds. No further action was taken after that, the Court was told.
The residential premises continued to be used for commercial and educational activities until the recent tragedy, in which 15 students died.
The sequence of events raises an important question over how effectively planning and building regulations are enforced. A demolition order being recalled on technical grounds, followed by years without further action, has now become a key issue before the Supreme Court.
Court Questions Inaction
Taking note of the developments, the Court said the sequence of events raised serious concerns over the enforcement of planning regulations and the accountability of public officials.
“Learned Amicus Curiae submits that a recent tragedy claimed the lives of 15 students in a building where commercial activity was being carried on. It is submitted that pursuant to the said incident, action has now been taken and the building has since been demolished,” the Court noted.
The Court further recorded that a demolition order had originally been passed on May 10, 2016, but was recalled on July 5, 2016, on a technical ground by the same authority that had passed it. No further action was taken until the tragedy, it said.
LDA Vice-Chairman Summoned
The Supreme Court directed the LDA Vice-Chairman to remain personally present on the next date of hearing and explain why appropriate orders should not be passed against him for alleged non-compliance with the Court's directions.
“This Court is constrained to issue notice in the contempt proceedings, as it is an admitted position that no effective action has been taken against those who have blatantly violated the sanctioned land use prescribed under the Master Plan,” the Court said.
“The Vice-Chairman, Lucknow Development Authority, shall remain personally present on the next date of hearing to show cause as to why appropriate orders should not be passed against him for non-compliance with the orders of this Court,” it ordered.
The direction puts the focus not only on the violations at the building but also on whether officials responsible for enforcing planning regulations acted when they were required to do so.
SIT Report Sought
The Court also directed that the Special Investigation Team (SIT) report prepared after the incident be produced before it in a sealed cover on the next date of hearing.
The Bench was hearing a miscellaneous application in a Special Leave Petition (SLP) concerning the apparent failure of authorities to enforce land-use regulations and building laws.
The Court observed that no effective action had been taken against those responsible for violating the sanctioned Master Plan.
Nationwide Scope Expanded
The issue has implications beyond Lucknow. In an order dated March 25, 2026, the Supreme Court expanded the scope of the matter nationwide and directed that all states and Union Territories be made parties to the proceedings.
The move underscored the wider concerns surrounding urban planning, enforcement of building regulations, and public safety in state and Union Territory capitals.
