Prayagraj: The Allahabad High Court has quashed criminal proceedings in a gangrape and robbery case, which was pending in the trial court, after both parties reached a settlement. The court imposed a fine of ₹2,000 each on the victim and the accused.
Justice Dr. Gautam Chaudhari's bench, while ruling on a petition filed by Munish and two others from Badaun, made strong observations regarding the misuse of legal processes. The court stated that "law is a means of justice, not a weapon for conspiracies."
It noted that it has become a common practice for individuals to file cases to settle scores with opponents and then retract their statements later. Therefore, the court cannot remain a silent spectator to such practices.
This ruling support the judiciary's concern over the increasing trend of filing false or manipulated cases, only to withdraw them after out of court settlements. The court's decision to impose a fine aims to deter such practices and uphold the sanctity of the legal system, ensuring that it is not exploited for personal vendettas or ulterior motives.
