Bihar's Longest-Serving Chief Minister Nitish Kumar Resigns As MLC

Bihar CM Nitish Kumar and BJP leader Nitin Nabin resigned from the state legislative council and assembly after being elected to the Rajya Sabha. Nitish, an MLC since 2006 and former CM, submitted his resignation formally, while Nabin, a five-time MLA, announced his via social media. Both moves follow constitutional rules on simultaneous membership.

Patna: Bihar chief minister Nitish Kumar and BJP president Nitin Nabin on Monday resigned from the membership of state legislative council and assembly respectively after being elected to Rajya Sabha.

Confirming Nitish`s resignation as MLC, Bihar legislative council chairman Awadhesh Narain Singh told newspersons that Nitish offered his resignation from the membership of the legislative council when he paid a courtesy visit to the chief minister`s official residence at 1, Anne Marg in the morning.

Later, JD (U) MLC Sanjay Gandhi reached Bihar legislative council and formally handed over Nitish`s resignation to the chairman, Singh. The chairman said that  Nitish`s resignation had been accepted, and the seat would be declared vacant after completing the necessary formalities.

Senior JD (U) leader and Bihar parliamentary affairs minister Vijay Kumar Chaudhary said that Nitish resigned from the legislative council as per the constitutional provisions. He also hinted at Nitish resigning from the post of chief minister in the coming days.

Nitish has been a member of Bihar legislative council since 2006. He was elected to the upper house of the state legislature for the fourth consecutive term on May 7, 2024 as his present term was to complete on May 6, 2030. He was elected to Rajya Sabha on March 16 this year, joining a group of leaders who have been  a member of both houses of the parliament as well as of the state legislature. He was first elected to the state assembly from Harnaut in 1985 while to Lok Sabha in 1989.

BJP President Nitin Nabin Resigns As MLA

Meanwhile, BJP president Nitin Nabin resigned as MLA after his election to Rajya Sabha. He announced his resignation on social media, addressing his constituents from Bankipur.  

After the sudden demise of his father, Navin Kishore Prasad Sinha, he successfully contested the by-election held later. He was elected to the assembly for the first time from the Patna West constituency on April 27.

He won from Bankipur assembly constituency for four consecutive terms since 2010, thus becoming a five-time MLA. He also held key portfolios like road construction, urban development and house and law in Bihar government. 

Under the ‘Prohibition of Simultaneous Membership Rules, 1950’ (framed under Articles 101 and 190 of the Constitution), a person elected to both Parliament and a state legislature must vacate their seat in the state legislature within 14 days of election to the Rajya Sabha.
