Bar council of West Bengal writes to CJI seeking removal of acting justice Rajesh Bindal of Calcutta HC

Kolkata: Bar Council of West Bengal’s chairman Ashok Kumar Deb on Sunday wrote a letter to the Chief Justice of Supreme Court demanding immediate withdrawal of Acting Justice Rajesh Bindal of Calcutta High Court.

In his letter, the Bar Council’s chairman also mentioned how the Jammu Kashmir Bar Council Association had ‘boycotted’ court of Justice Bindal over his ‘disgruntled’ behavior in 2019.

Some of the reasons mentioned on why the Bar Council West Bengal chairman wanted removal of Justice Bindal?

1. The way Bindal had stayed the lower court’s bail order over Narada trial clearly shows Bindal’s favour to certain political parties.

2. Five member division bench headed by Justice Bindal has allowed repeated requests by the CBI over filing of affidavits but declined the requests of TMC Supremo Mamata Banerjee and TMC leader Malay Ghatak to file affidavits to contest the matter clearly shows that Bindal is politically biased.

3. The election petition filed against Suvendu Adhikari by Mamata Banerjee was registered with single bench of Justice Sabyasachi Bhattacharya which Justice Bindal snatched and gave to Justice Kaushik Chanda knowing Justice Chanda’s long association with the Bharatiya Janata Party (BJP).

4. The social media posts and Justice Bindal’s frequent visit to Governor House clearly gives an impression that he is an out and out BJP man.

Mentioning these reasons along with few other reasons, Ashok Kumar Deb had urged the Chief Justice of the apex court to take immediate action on removing Justice Bindal ‘to ensure people’s confidence in the judiciary and to preserve the sanctity of Calcutta High Court’.
