Jabalpur (Madhya Pradesh): An Urdu teacher from Katni, was transferred to a school where neither a sanctioned Urdu post nor Urdu students were available.
Taking note of this, the Madhya Pradesh High Court on Tuesday ordered that Urdu teachers should only be posted where both a sanctioned post and students for the subject exist.
The court also directed that the representation filed against the transfer be resolved within 30 days.
According to information, the order was given by Justice Maninder Singh Bhatti of the High Court’s single bench during the hearing of a petition filed by Ilyas Ahmed, a resident of Azad Chowk, Katni.
The petitioner was represented by advocates Shankar Prasad Singh and Padmavati Jaiswal.

Ilyas Ahmed was appointed as an Urdu subject teacher at Government Middle School, Khamaria No. 2. However, the District Education Officer (DEO) of Katni transferred him to Government Primary School, Kothi, Dhimarkheda, a school where there is no sanctioned post for Urdu nor any students to study the subject.
This transfer led to a dispute, and Ahmed submitted representations to the DEO Katni, the Katni Collector, and the Directorate of Public Instruction in Bhopal, requesting cancellation of the transfer.
He also stated that as per a government circular, he should be exempted from transfer since he is an office bearer of a recognised employee union. However, no action was taken despite repeated requests, which forced him to approach the High Court.
High Court’s Decision
The court observed that since the teacher was appointed specifically for the Urdu subject, transferring him to a school with no Urdu students and no Urdu teaching post is not only practically wrong but also against the interest of education.
The court ordered that the teacher should be allowed to continue working at a school where both Urdu students and a sanctioned post are available.
Additionally, the court directed that the representation submitted against the transfer should be resolved within 30 days.
