Sweets Undelivered In Spain: Bhopal Forum Orders To Pay ₹10K For Emotional Suffering; Other Costs Added Too

Bhopal (Madhya Pradesh): Bhopal District Consumer Grievances Redressal Forum has ordered a courier company to pay compensation of Rs 21,000 for not delivering sweets in Barcelona in Spain.

The forum has asked courier company to pay Rs 6,400 as courier charges and Rs 1,350 as goods’ value to the petitioner. The total sum stands to Rs 7,750 added to which is 7% annual interest from December 16, 2019 till May 2025.

Besides, Rs 10,000 has been ordered to be paid as compensation for emotional, physical and financial suffering. The forum also ordered to pay Rs 5,000 as litigation cost. Thus, the total amount to be paid by courier company to the petitioner stands at Rs 21,000.

Ravi Srivastava, a resident of Surendra Gardens on Hoshangabad Road, Bhopal, had booked homemade sweets through courier for his son in Barcelona, Spain, on October 21, 2019 ahead of Diwali. A parcel weighing 4 kilograms included homemade sweets and dry fruits worth Rs 4,000.

After receiving charges, the courier company informed Srivastava through email that the food items are banned in Spain and they cannot be sent through courier service.

Srivastava approached forum on ground that courier company should have informed about it before accepting the parcel. The forum ruled that courier company packed and accepted the parcel despite international restrictions. The companies failed to deliver the parcel and inform the customer on time. The lack of proper service caused emotional and financial damage.

Advocate Sangeeta Moharir who appeared on behalf of complainant said, “Forum accepted that it is deficiency in service on part of courier company as sweets were not delivered in Spain. If there was restriction in Spain on such a parcel, parents should have been informed before booking the parcel.”
