Madhya Pradesh High Court Stays Property Takeover By Waqf Board

Bhopal (Madhya Pradesh): The Madhya Pradesh High Court, principal bench of Jabalpur on Monday stayed the takeover of property of a person from Rewa by MP Waqf Board while issuing notices to respondents in the case, including MP Waqf Board.

Justice Vishal Dhagat ordered the MP Waqf Board to maintain status quo in the matter and issued notices to respondents, including the Waqf Board.

Haji Mohammad Ali of Rewa, filed a petition in the HC. As per the petition, his grandfather late Abdul Mannan constructed a tomb of his ancestor Abdul Mannan Haji Syed Zahoor Ali, on his land at Amahia in Rewa district 100 years ago.

The land in question was never donated to MP Waqf Board by him or any of his ancestors. Despite this, MP Waqf Board registered his land as Waqf property without informing him or any of his ancestors or giving them a chance of hearing.

Advocate Sheetla Prasad Tripathi, who appeared on behalf of the petitioner said, ‘Waqf Board had made gazette notification after acquiring land but the HC has instructed to maintain status quo. Now Waqf Board will not be able to acquire the property.’
