SC Grants Custody Parole To AIMIM Candidate & 2020 Delhi Riots Accused Tahir Hussain For Assembly Polls, But On Conditions

New Delhi: In a major relief to Tahir Hussain, the Supreme Court on Tuesday granted custody parole to the AIMIM candidate and Delhi riots accused for campaigning in the Delhi Assembly Elections 2025. Husain was reportedly allowed to campaign from January 29 till February 3. Notably, Hussain is accused of killing an Intelligence Bureau (IB) officer during the 2020 Delhi riots.

Hussain's plea seeking permission to campaign in the upcoming Delhi polls was heard by a three-judge bench of Justices Vikram Nath, Sanjay Karol and Sandeep Mehta.

Conditions Imposed On Custody Parole Of Tahir Hussain:

Meanwhile, the court imposed certain conditions on the AIMIM's custody parole. Hussain would only be allowed to leave jail along with security during the day time and return each night.

The top court directed that the AIMIM candidate shall bear all the expenses for his custody parole including for Delhi police officials to be deputed with him and jail van and escort expenses.

As per the apex court, Hussain shall be released from jail as per the jail manual upon the deposit of the expenses i.e. Rs 2.07 lakh for 12 hours.

Senior advocate Siddharth Aggarwal, appearing for Hussain, argued that only four-five days were left for campaigning. "The place where my house is alleged to have been where the Delhi riots took place. I am fighting from Mustafabad seat and even for staying purposes, I am saying I will not go to the house and will stay in a hotel and provide details," Aggarwal said as quoted by PTI.

Additional solicitor general (ASG) S V Raju opposed the plea. ASG Raju said that Hussain's role in the riots was serious.

Hussain is contesting the 2025 Delhi polls from the Mustafabad seat on the AIMIM ticket against AAP's Adeel Ahmad Khan, BJP's Mohan Singh Bisht and Congress's Ali Mahndi.

Delhi polls are scheduled to take place on February 5 and the results will be declared on February 8.

Earlier this month, the former councillor failed to secure interim bail on January 22, after a two-judge Spreme Court bench gave a split verdict.
