Jabalpur (Madhya Pradesh): High Court at Jabalpur has dismissed a petition of a woman after she did not explain the delay of almost 8 years to get remains/bones of her missing father from the police in Umaria district.
Justice Vishal Mishra said ‘There is no document on record to demonstrate that those bones are still retained by the respondent department’.
'The petitioner has given no explanation for approaching the Court with a delay of almost 8 years’, the court said.
'It is clear that the petitioner has slept over her right for a considerable period. Therefore, no relief can be extended to the petitioner', the court said.
The father of the petitioner went missing in 2011 and he was subsequently found dead.
The petitioner Anjali Sakuntla Vishwakarma filed an application before the police to get a DNA test done on November 28, 2017, and a DNA test was conducted on the basis of the petition.
However, now after a lapse of almost 8-9 years, the petitioner has made a representation to Superintendent of Police, Umaria district on July 4, 2025 requesting that remains/ bones of deceased father be handed over to her.
There is a closure report filed way back on December 31, 2017 which was duly accepted by the court (at Umaria).
The HC said the Supreme Court has pointed it time and again that a party who has slept over his right is not entitled to the discretionary relief of the High Court.
