Bhopal (Madhya Pradesh): The Madhya Pradesh High Court’s principal bench at Jabalpur has asked Netaji Subhash Chandra Bose (NSCB) Medical College, Jabalpur, to return all documents to a postgraduate student without charging Rs 30 lakh under the seat-leaving bond condition.
The directive came in the case of Dr. Nisha Singh Rawat, a PG student from Bhopal, who was allotted a microbiology seat at NSCB Medical College for the 2023–24 academic session.
She was forced to discontinue her studies due to the death of her father and the need to care for her mother in Bhopal. She now wishes to rejoin as a demonstrator in the Department of Community Medicine at Gandhi Medical College (GMC), Bhopal.
Dr. Rawat approached the court after NSCB Medical College demanded ₹30 lakh as per the seat-leaving bond rule. However, the National Medical Commission (NMC) has already directed all states and UTs to withdraw the ₹30 lakh bond condition.
In response, the Madhya Pradesh government issued an order on June 15, 2024, stating no bond amount would be charged for students leaving PG seats — but applied the order only prospectively, i.e., for students admitted in 2024 and onwards.
Senior advocate Aditya Sanghi, representing the petitioner, argued that the bond serves little purpose now, as PG medical seats have increased significantly, and many remain vacant. He also said that the issue of seat-blocking is only relevant during counselling, not after admission deadlines have passed.
