As per bank rules, the complainant visited Sagvekar's house the next day at 12.30 pm for address verification. She claimed that Sagvekar was alone in the house and misbehaved with her when she was leaving after completing the verification process. The woman rushed back to the bank, narrated the incident to her bosses and staff, and lodged a case against him. The defence claimed that the victim did not shout or ask for help and that there were no eyewitnesses.
The court, however, said: “As the incident took place in a closed room, hence, there was no eyewitness present in the room. Due to fear of defamation, the informant could not have made hue and cry in the society of the accused.” Thus, on the basis of the testimony of the victim, the court held the accused guilty of molesting the bank officer.
