Newly elected Shiv Sena (UBT) corporator Milind Vaidya was booked along with over 40 others for holding an unauthorised victory procession in Mahim after the 2026 BMC polls. Police said prohibitory orders were in force and permission for the rally was denied, yet the procession was held using loudspeakers and firecrackers.

Prohibitory Orders in Force
According to the FIR filed by Police Constable Pradeep Bhikan Mahajan of Mahim police station, the Mumbai Police Commissioner had issued prohibitory orders under the Maharashtra Police Act on January 8, 2026, which were in force from 12.01 am on January 12 till midnight of January 26, 2026.
In view of the prohibitory orders, Vaidya was served a notice on January 16, 2026, under Section 37(3) of the Maharashtra Police Act and Section 168 of the Bharatiya Nagarik Suraksha Sanhita, directing him to maintain law and order and refrain from any activity that could disturb public peace within the jurisdiction of Mahim police station.
Permission Denied Repeatedly
Despite winning the civic polls held on January 15, Vaidya’s request for permission to take out a victory procession was denied by Mahim police on January 17, citing the prevailing prohibitory orders. Subsequent applications submitted on January 22 and January 24 were also rejected for the same reason, police said.
However, the FIR states that on January 24, 2026, at around 5.30 pm, Vaidya and his supporters allegedly took out an unauthorized victory rally, which continued till 8.30 pm. The procession allegedly passed through Fisherman Colony, Nayanagar, Mori Road, Mahim Dargah and Retibunder, Mahim West, during which loud music was played and firecrackers were burst on public roads.

Following the incident, Mahim police have registered a case against Vaidya and his associates, including Vinay Akre, Avirat Shinde, Santosh Surve, Deepak Sawant, Nasir Sheikh, Mahesh Davane, Deepak Tirodkar, Anish Sheikh, Shahid Sheikh, Sandeep Keny, Machhindra Tamore, and 30 to 40 unidentified persons.
The accused have been booked under relevant sections of the Maharashtra Police Act and the Bharatiya Nyaya Sanhita (BNS) Act, for allegedly violating police orders, disobeying the Commissioner of Police’s directives, forming an unlawful assembly, and disturbing public order by conducting an unauthorized victory procession.
