Krishna Janmabhoomi Case: Plea To Refer 'Shahi Idgah Mosque' As 'Disputed Structure' Dismissed By Allahabad High Court
The Allahabad High Court on Friday dismissed Hindu side's plea to substitute the term 'Shahi Idgah Mosque' with 'disputed structure' in all future proceedings.

Allahabad: The Allahabad High Court on Friday dismissed a plea of the Hindu side in the ongoing case related to the Krishna Janmabhoomi-Shahi Idgah dispute. The Hindu side had filed the plea to substitute the term 'Shahi Idgah Mosque' with 'disputed structure' in all future proceedings related to the cases before the high court, reported Live Law.
A bench of Justice Ram Manohar Narayan Mishra dismissed the plea filed by advocate Mahendra Pratap Singh. A total of 18 petitions filed by various members of the Hindu side have been clubbed together. These cases are pending before the Allahabad High Court.
The next hearing has been scheduled for August 2.
Earlier, on August 1, 2024, the high court had rejected applications of the Muslim side challenging maintainability of suits of Hindu worshippers and held that all suits of Hindu worshippers are maintainable.
In the August 1 order, the HC had also held that these suits were not barred by Limitation Act, Waqf Act and Places of Worship Act,1991, which prohibit conversion of any religious structure as existed on August, 15, 1947.
All About The Dispute:
The dispute is related to the Shahi Eidgah mosque in Mathura. This mosque is dated to the Mughal era under Aurangzeb's regime. It is being alleged that a temple believed to be at the birthplace of Lord Krishna was demolished by the Mughals to build the mosque.

A "compromised" agreement was reached between the Shri Krishna Janmasthan Seva Sansthan and the Shahi Eidgah committee in 1968, under which it was agreed that the mosque and the temple would exist side by side.
The Allahabad High Court transferred all the cases related to the dispute to itself in May 2023. The high court granted a plea to appoint a court commissioner to inspect the Shahi Eidgah mosque in December 2023. However, the Supreme Court stayed the order in January last year.
