The Finance Ministry has clarified that provisional Goods and Services Tax (GST) refunds will not be processed automatically when earlier refund orders are under dispute or subject to pending appeals.

The clarification follows the 57th GST Council's decision to accelerate refund processing for eligible taxpayers.

Under the revised mechanism, low-risk refund claims involving zero-rated supplies or an inverted duty structure can receive 90% of the claimed amount within three working days of acknowledgement, without intervention by a tax officer.

Zero-rated supplies include exports and supplies to special economic zones, while an inverted duty structure arises when input tax rates exceed those applicable to finished products.

GST refund automation excluded for disputed claims

In its Frequently Asked Questions (FAQs), the ministry identified three circumstances requiring officer verification before provisional refunds can be released.

The first involves cases where authorities have issued a show-cause notice concerning an earlier refund order.

The second covers situations where the department has challenged a previous refund order before an appellate authority and the appeal remains pending.

The third applies when an appeal filed by the department is awaiting a decision from the GST Appellate Tribunal.

Such applications will undergo manual examination instead of automatic provisional approval.

However, the restrictions do not extend to every refund category.

Unused balances in taxpayers' electronic cash ledgers will continue to be refunded through a separate automated process without officer involvement.

Refund acknowledgement timeline reduced

The GST Council has also proposed reducing the time allowed for acknowledging refund applications or identifying deficiencies from 15 days to 10 days.

If an officer neither acknowledges an application nor raises deficiencies within that period, the system will treat it as accepted.

However, automatic provisional refunds will remain unavailable to notified suppliers of areca nut, pan masala, tobacco and essential oils.

Businesses that have not completed Aadhaar authentication will also be excluded.

Additionally, the existing restriction on refunds of accumulated input tax credit under the inverted duty structure for specified goods notified in 2017 will continue.

The changes aim to accelerate eligible refunds while retaining additional scrutiny for disputed claims and excluded taxpayer categories.
