Madhya Pradesh: HC Modifies Stay Order In Civil Judge Recruitment, Directs To Complete It Soon

Bhopal (Madhya Pradesh): High Court, principal bench of Jabalpur on Friday modified the stay order dated January 24 in connection with civil Judge recruitment and directed to complete it within three months.

The entire process was stayed by the Division Bench of the High Court on the initial hearing of the said petition dated January 24. But on March 3, the Supreme Court has given instructions to immediately fill vacant posts of Civil Judge.

On Friday, the Division Bench of Chief Justice Suresh Kumar Kait and Vivek Jain modified the interim order dated January 24 and directed to complete the entire recruitment process within three months, and all the said recruitment / appointment will be subject to the final decision of the petition.

HC had issued an advertisement on November 17, 2023 for 138 posts of Civil Judge, Junior Division (Entry Level) including 06 posts for Divyangs. According to the said advertisement, 31 posts for unreserved category and 17 posts for unreserved category, 09 posts for Scheduled Caste and 11 posts for Divyangs, 12 posts for Scheduled Tribes and 109 posts for Scheduled Castes, 09 posts for OBC and 01 post for Divyangs, 06 posts for Divyangs. Thus an advertisement was issued for the fulfillment of a total of 138 posts for Civil Judge.

Senior advocates Rameshwar Singh Thakur said, ‘The strong ground is that the unreserved category is never eligible and the requirement of 20 marks out of 50 in the interview is unscientific.

There is a rule to select three times the number of candidates for interview, but the High Court did not include even a single candidate of the reserved category. In the unreserved category, 59 candidates were selected for interview and 15 candidates of OBC and only three candidates of SC and not a single candidate of ST were selected.’
