Aryan Khan has moved a special court dealing with cases under the Narcotic Drugs and Psychotropic Substances Act (NDPS) seeking that the Narcotics Control Bureau (NCB) return his passport as it has exonerated him from the drugs case.

The 24-year-old had been arrested in the drugs seizure case in early October last year and was granted bail by the Bombay High Court after three weeks in prison. The central agency had filed its chargesheet in the case in May this year in which it had exonerated him among five others stating that there is lack of sufficient evidence against them.

In his plea, he has also sought cancellation of his bail bond, which requires a person to attend court till the end of trial, while he or she is out on bail. It stated that in compliance with the bail condition imposed by the Bombay HC he had duly surrendered his passport before the special court on Oct 29 last year. It said further that pertinently he has not been arraigned as an accused in the complaint filed by the NCB, as there was no incriminating evidence against him. It further mentioned that the court had taken cognizance of the chargesheet and summoned the accused, the facts clearly depicting that he has been exonerated from the matter and is no longer an accused in it.

The plea further stated that it would be in the interest of justice, just and proper for the bail bond to be cancelled and his passport to be returned to him.
