Sheena Bora murder case: Special court rejects Indrani Mukerjea's plea to cross-examine Rahul
In the oral reasoning, the court said that the plea seeking permission for self-representation cannot be granted in murder trials
Mumbai: A special court on Tuesday rejected the prime accused Indrani Mukerjea’s plea to be permitted to cross-examine the witness and her ex-stepson Rahul Mukerjea, a key witness in the case.
In the oral reasoning, the court said that the plea seeking permission for self-representation cannot be granted in murder trials. It relied on the Bombay High Court’s Nagpur bench’s order which had sent back the case to the trial court as the accused had self-represented.
Making submissions seeking permission to self-represent, Indrani had told the court that her advocate had an extremely busy schedule and hence, would not be available on the trial date.
She further said that in her advocate’s absence, she wanted to exercise her right so that the trial does not get delayed.
She also submitted that she would not hold the court responsible for any consequences that might arise from her decision to self-represent herself.
The special Central Bureau of Investigation (CBI) court also decided that Sheena Bora's birth certificate cannot be produced before it as evidence. The documents had been produced by the agency as part of the documents that had been given to Rahul Mukerjea by Sheena. The accused, including Indrani, had disputed the documents.
The court, in its oral reasoning, said that the witness (Rahul) did not have personal knowledge of the documents and that his knowledge is based on what Sheena told him.
