Rarest of rare case, Court has reduced the personal bond amount for a woman from ₹ 70,000 to ₹10,000

Jabalpur (Madhya Pradesh): A division bench of the High Court in Jabalpur, considering it rarest of rare case, has reduced the personal bond amount for a woman from ₹ 70,000 to ₹ 10,000, enabling her release from jail.

The woman was unable to furnish the personal bond because of poor financial condition, and was languishing in prison for five and a half years, despite her sentence being suspended by High Court on January 8, 2020.

A division bench of Justice Vivek Agrawal and Justice AK Singh said the present one is the rarest of rare case.

Therefore, we are showing indulgence because personal liberty and freedom of the appellant is in jeopardy for over five and a half years during suspension of sentence, the court said.

On September 9, 2014, the trial court convicted the appellant Vidya Bai to life imprisonment and imposed a fine of Rs 10,000 after finding her guilty for murder of her husband Surendra Upadhyay.

On January 8, 2020, High Court suspended the sentence, considering the prosecution did not complete the chain to prove she had committed the murder.

And, the court ordered that she be released on bail on furnishing a personal bond of ₹ 70,000 and depositing the fine imposed by the trial court.

The court was informed that the woman had deposited the fine amount but was unable to furnish a personal bond therefore, the order of January 8, 2020, be modified.

The court directed the State government that in case of her furnishing a personal bond of ₹ 10,000, the appellant Vidya Bai may be released from custody if she is not required in any other case.
