Mumbai Sessions Court Grants Bail To Haryana Man In Cheating Case, Cites 5-Year Delay In FIR
A Mumbai sessions court granted bail to a Haryana man accused of cheating a woman of ₹6 lakh, citing a five-year delay in filing the complaint. The court noted the nature of the relationship and lack of immediate action, while the prosecution’s claims of habitual offences were considered but did not prevent bail.

Mumbai, April 1: The Sessions Court has granted bail to a 45-year-old Haryana resident for allegedly cheating a city-based woman, citing delay in registering the case. The man is accused of having lured the woman into a relationship and allegedly made her part with her savings since 2021.
Accused and case details
The accused, namely Yash Agarwal alias Khel Singh alias Armaan Malik alias Kapil Bansal, was booked by Sahar Police Station on the complaint of a city-based woman running a recruitment and software development company.
The woman had claimed that she came in touch with the accused during a professional interaction in 2021. The woman claimed that on February 21, 2021, the accused called her for a meeting at a restaurant.
She claimed that during the meeting, he mixed something in her drink, and after that she felt uneasy. Later, he took her to a hotel in his room and subjected her to physical relationship.
Allegations and financial loss
The woman claimed that the next morning she confronted him and the accused pacified her and promised to marry her. He later called her driver and dropped her home. The accused later met her family and kids and won her confidence.
The woman claimed that the accused, between 2021 to 2026, made her part with around Rs 6 lakhs. Five years later, the woman realised that she had been cheated, hence lodged a complaint with Sahar Police Station on January 7. The man was arrested on February 26.
Defence arguments
The accused, in his bail plea, took the ground of delay in lodging of the complaint and said that there is no valid explanation for the lapse of five years. The man claimed that he is suffering from cancer and heart problems, which is supported by medical evidence.
Prosecution stance
The prosecution, however, opposed his bail, claiming that the applicant is a habitual offender. “As many as 5 cases of cheating and criminal breach of trust are pending against him in various courts at Gurgaon, Haryana and Tis Hazari Courts. Thus, the applicant is a cheater from Haryana State,” the prosecution argued.
It was further contended that he had changed his identity and was staying in Mumbai. Therefore, there is every possibility that he will flee away from justice.

Court observations
The court, however, accepted the contention of the defence and said, “the informant is 48 years of age. She was knowing the consequences of her actions. In spite of that, she had kept relations with the applicant. After lapse of 5 years, she lodged this complaint. The nature of offence and allegations made in the complaint themselves shows that there was a consensual sexual relation between the applicant and informant.”
