New Delhi: The Supreme Court is scheduled to hear on Monday a plea seeking an independent and time-bound CBI investigation into alleged irregularities and malpractices in the Jharkhand Combined Civil Services Preliminary Examination.

A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana is likely to hear the petition filed by activist Harisharan Devgan through advocate Satyam Singh Rajput.

The plea has been filed under Article 32 of the Constitution, raising concerns over the fairness, transparency and credibility of the examination conducted by the Jharkhand Public Service Commission (JPSC).

The petitioner has sought the transfer of the investigation from the state CID to the Central Bureau of Investigation, arguing that an independent agency is required to ensure an impartial probe.

The plea states that the issue cannot be treated merely as a dispute involving individual candidates or isolated allegations of malpractice.

It seeks an examination of the entire examination process, including question paper preparation and printing, storage, transportation, distribution, conduct of the examination, custody of OMR sheets, evaluation process and electronic examination data management.

The petition has also sought immediate preservation of all relevant physical and digital evidence linked to the examination.

This includes original OMR sheets, candidate-held carbon copies, CCTV footage and server audit logs to prevent possible tampering or destruction of records.

The petitioner clarified that the plea does not seek cancellation of the examination merely on the basis of allegations or media reports.

Instead, it seeks an independent, comprehensive and time-bound investigation to determine the nature, extent and impact of the alleged irregularities.

The petitioner has argued that the matter raises a larger constitutional question regarding whether a recruitment examination conducted by a constitutional authority maintains the minimum standards of fairness, transparency, reliability and institutional integrity.

The plea states that the question of whether the preliminary examination results can be relied upon for public appointments should be decided only after an objective and evidence-based assessment.
