Sohrabuddin Encounter Case: Nayabuddin denies receiving threat call from ‘Amit Shah’

Mumbai: Nayabuddin Shaikh, brother of Sohrabuddin, who was killed in an alleged encounter, finally deposed on Monday in the Sohrabuddin Encounter Case. Nayabuddin finally appeared, after several summons a non-bailable warrant was issued against him. In his deposition Nayabuddin denied receiving any threatening calls by a politician named ‘Amit Shah’ or that he was offered Rs 50 lakh from the suspended IPS officer Abhay Chudasama to withdraw his petition from Supreme Court. Instead, he claimed, the Central Bureau of Investigation (CBI) had spoiled the case by adding statements he did not state.

After taking the witness box, Nayabuddin described how he was in constant contact with his brother Sohrabuddin before the encounter. He also told the special CBI court, around November 17, 2005, Sohrabuddin with his wife Kauser Bi had visited Hyderabad to return the Maruti van belonging to Kaleemuddin. “Sohrabuddin stayed in Hyderabad for three to four days. Later, on November 22, 2005, he informed me, he was proceeding to Sangli with Sangeeta Travels for a medical treatment of Kauser Bi,” said Nayabuddin He added, “He was going to return to Indore by November 25, 2005, but he did not. Upon inquiring with the sister of Kaleemuddin and Dr Prakash Bandivdekar, they said they were not aware of Sohrabuddin’s whereabouts.”

Nayabuddin claimed he got to know through news channels, an encounter had taken place in Gujarat. Later, a friend of his advised Nayabuddin to call the Crime Branch Officer, Makhwana. When he called up Makhwana, he was told, “There was no encounter by Crime Branch, enquire with Anti-Terrorism Squad (ATS).” Nayabuddin recalled, it was when he called the ATS, he was told, Sohrabuddin was killed in an encounter by Rajasthan police. He then informed his family, after which his brother Rubabuddin reached Ahmedabad in the early hours on November 27, 2005, when Sohrabuddin’s body was handed over to them. When they inquired about Kauser Bi they got to know Dr Amin injected her and killed her.

After his chief examination got over, Nayabuddin in anger asked Public Prosecutor BP Raju to show the statements that were recorded by CBI which he had not state. “The CBI Officer, Dagar has spoiled this case. I have not told the CBI Azam met me or IPS Officer Abhay Chudasama offered me Rs 50 lakh to withdraw the writ petition from Supreme Court,” said an angry Nayabuddin.  Nayabuddin submitted a photocopy of his affidavit dated September 9, 2010, filed to the Special CBI court, which said he did not receive any threat from Bharatiya Janata Party (BJP) government before his cross-examination. He requested the special CBI Judge to order the CBI to search for Kauser Bi’s body.
