Singhania family dispute: Raymond asked to allow inspection of two apartments in JK House

Mumbai: In a new development in the Singhania family dispute, the Bombay High Court on Monday allowed the inspection of two apartments of the JK House, Breach Candy, which are allotted to Akshaypat and his mother, Veena Devi Singhania. The HC has asked the Raymond company, the owner of the JK House, to allow the inspection of the total area of these two duplex apartments, before February 17.

A single-judge bench of Justice Burgess Colabawalla was seized with a petition filed by Raymond Limited, challenging the orders of the Arbitration Tribunal.  The tribunal, through its order passed in December 2018, directed Raymond to grant access to an architect and a valuer, to the ‘apartments’ of both Akshaypat and Veena Devi Singhania at the JK House.

This access was to enable the architect and the valuer to inspect the two duplex flats on the 21st and 22nd floors and the 23rd and 24th floors of the JK House. The two apartments in question are the subject matter of a suit filed by Raymond company against Akshaypat and Veena Devi.

The mother-son duo have claimed their rights on these two apartments, citing a tripartite agreement between Gautam Singhani, his cousin Akshyapat and aunt Veena Devi. Opposing the request of Akshaypat and his mother, the Raymond company claimed that the mother-son duo are very much aware of the total area of these two apartments.

The company further claimed that the duo want to enter in the apartments, under the guise of inspection. Appearing for Akshaypat and Veena Devi, advocate Birendra Saraf argued that the Tribunal was justified in allowing inspection and it was competent enough to pass such an interim order.

Having considered the contentions, Justice Colabawalla siad, “I am of the opinion that the view taken by the Tribunal is certainly a plausible view and suffers from no perversity. I am also of the view that to obviate any apprehension on the part of Raymond that this application has been preferred only to somehow gain access and enter upon the newly constructed JK House, I think it would be in the fitness of things if the interim order is modified to a very limited extent.”

Accordingly, Justice Colabawalla directed Raymond firm to allow the inspection, preferably before February 17, in the presence of an advocate of the HC. The bench has also asked Akshaypat and Veena Devi not to remain present during the inspection.
