Mumbai: Unique way to report unregistered projects

Mumbai: The Maharashtra Real Estate Regulatory Authority (MahaRERA) has initiated source information, a unique method to encourage people, aggrieved home buyers and others to inform them of the housing projects, which are not registered. A senior RERA official told Free Press Journal, the idea has been initiated to protect the identity of complainants who prefer being anonymous, a request made by many.

“If information pertaining to a housing project, which is not registered under RERA is received, the concerned developer or builder is called by the authority. He is questioned for not registering the project. They are then forced to register,” added the official.

MahaRERA started the source information nearly a month and a half ago. By way of source information the authority can act against developers since the officials cannot go to the various housing project sites and check on the status.  As per the MahaRERA Act 2016, only those housing projects can be registered under RERA which have received the Commenced Certificate (CC) or have got approvals from some planning authorities.

“Many times, developers do a soft launch of their housing projects, like they purchase a land and they advertise their project will soon come up, even without any CC or approval from the planning authority. Such projects cannot be registered under RERA as it does not give the home buyers any surety,” said the official.

According to the records with MahaRERA, around 18,491 developers have sent applications for registration. Out of these, 18,392 have been granted the registration under RERA. Further, those projects which are granted registrations, 3,012 projects have been completed as on November 2, 2018, said the official.

In addition, those buildings which are already occupied by tenants and has no Occupancy Certificate (OC) they do not come under the RERA purview. The officer explained, “In Mumbai, there are several buildings which have completed construction five years ago and tenants have occupied these flats without any OC. Since these are old projects, complaints against them cannot be registered.”
