Mumbai: Congress, Shiv Sena, BSP likely to face contempt proceedings

Mumbai: The Bombay High Court on Friday issued show cause notices to Congress, Shiv Sena and the Bahujan Samaj Party (BSP) asking why contempt proceedings should not be initiated against these political parties for putting up illegal hoardings, across Maharashtra.

The HC has also asked the three parties to file their say by March 27. A division bench of Justices Abhay Oka and Ajay Gadkari also warned that if these parties failed to file their replies, it would then issue notices to their leaders.

“Prima facie, we are of the opinion that the Congress, Shiv Sena and the BSP have indulged in displaying illegal hoardings and banners across the state,” Justice Oka said. “We are of the considered opinion that these parties have breached the orders of this court, by which prohibition was imposed on display of illegal hoardings and banners.

Thus, we issue show cause notices to these parties asking why contempt proceedings should not be initiated against them,” Justice Oka added.  The judges have asked these parties to file their say by March 27. “If these parties fail to take this issue seriously even now, then we will be left with no option other than issuing notices to their leaders,” warned Justice Oka.

The bench was seized with a bunch of petitions highlighting the defacing of the city because of rampant illegal hoardings put up by all political parties in various nooks and corners of the city. Meanwhile, activist Zoru Bhathena filed an intervention application highlighting the blatant breach of court orders, especially by the Bharatiya Janata Party (BJP) in Bandra area.

According to Bhathena, BJP leaders like Ashish Shelar, Poonam Mahajan etc have put up illegal hoardings in Bandra despite filing undertakings in the court for not displaying unauthorised banners. The bench has admitted his application and has posted the matter for hearing on March 12.
