New Delhi: The Supreme Court on Friday dismissed a petition for demolition of a building under construction at Sankli Street Cross in Byculla, Mumbai, challenging its ownership. The Bench of Justices Rohinton Fali Nariman and Vineet Saran upheld upholding rejection of the writ petition of Mohd Tarique Ansari by the Bombay High Court in November.
He had challenged Azizur Rehman building a new multi-storeyed building in place of Chunawala Cottage after buying it from Abdul Sattar Fazluddin Chunawala in 2002 and entering into agreements with all 45 tenants and paying them rent in lieu of transit accommodations.
The High Court had dismissed the petition on the ground that Tarique”s father had also executed the agreement and got rent up to his death in March 2018 from Azizur Rehman and he could not establish that the purchase deal was fabricated and bogus since even Chunawala who was alive till 2012 nor his legal heirs made any complaint against the purchase.
The building”s construction began in 2017 and 11 floors had been built up to the time the High Court threw out Tarique”s writ petition, seeking orders to the Municipal Corporation of Greater Mumbai to demolish the alleged illegal construction.
