Builder held liable for not providing agreement copy

Thane : The District Consumer Redressal Forum has held an Ambarnath-based builder liable for deficiency in service for failing to provide a copy of the agreement of sale and ordered him to pay a compensation of Rs 5 lakh to a buyer.

The panel of forum president Umesh Jhavalikar and member N D Kadam directed Sharwan Kumar Bagaria, the builder, to refund Rs 1.50 lakh to the complainant Sherpal Singh, a resident of Badlapur in the district.

According to Singh, he booked a row-house in a project being developed by Bagaria in 2007 and paid him Rs 1.5 lakh in advance, of the total cost of Rs 9.5 lakh. But as the builder did not provide him with a copy of the agreement of sale, he could not get a bank loan, Singh said. Consequently, the sale did not go through. The forum held that this was ‘a deficiency in service’ and the builder should pay compensation of Rs 5 lakh, and also refund the advance. -PTI
