Bombay High Court: No holding back Maratha quota report

Mumbai: In a setback to the Maharashtra government, the Bombay High Court on Monday trashed all its misgivings about making public the report which recommended reservations for the Maratha community. The court has now asked the government to hand over to it the entire report, prepared by the State Backward Class Commission (SBCC).  Ever since the commission submitted its report, the government had claimed that making it public would fan communal tension.

In fact, Advocate General Ashutosh Kumbhakoni had also submitted that 20 pages of the report, if made public, could create a law and order situation, as these pertained to the history of the Marathas.  A division bench of Justices Ranjit More and Bharati Dangre, however, trashed all the apprehensions, saying, “There is nothing worrisome.

We have vetted the entire report and we did not find anything in it which can create a situation, as apprehended by the government,” said Justice More while directing the government to hand over copies of the report to all the petitioners. “The report must be given as it is, there is no need for any deletion or masking,” Justice More added.

The bench has accordingly directed the government to hand over the copies to all parties by Tuesday.  The bench was seized with a bunch of petitions challenging the decision of the government to grant 16 per cent reservation to the Maratha community in government jobs and educational institutions. The matter has now been adjourned to February 6, the day when the bench will commence hearing final arguments.
