Malegaon blast case SPP Salian accused of professional misconduct in plaint

Mumbai : Former special public prosecutor in the 2006 Malegaon bomb blast case Rohini Salian has been accused of professional misconduct. A complaint in this regard has been filed before the State Bar Council.

“Tarachand Singh, elder brother of one of the accused in the Malegaon blast case Manohar Narivaria Singh, has filed the complaint against Ms Salian before the Bar Council of Maharashtra and Goa,” Adv. Sujendra Yadav counsel who filed the complaint told FPJ.

Singh has raised objections over Ms Salian’s conduct in the court as a public prosecutor as well as outside the court, especially her press conference on June 26, 2015, wherein she was quoted to have said – “Since the new govt came, I have been told to go soft on accused (Hindu Extremists)” and ‘Hindu’ officers were pulling strings even when UPA was in power”.

Salian’s statement brings disrepute towards the government, divides accused on their religious lines and attributes bias to the investigating agency by analyzing their actions on religious lines thereby promoting enmity between different groups, the complaint argues. The complaint also accuses Ms Salian of conducting media trial and “bombarding peoples’ minds with information that concerns the sensitive details of investigation”.

Singh, in his complaint, has also accused Ms Salian of having ulterior motives and undermining the rights of the accused in the Malegaon bomb blast case.

The complaint also accuses Ms Salian selectively revealing facts before the court, which the complaint terms as “gross negligence and clear cut deficiency in the service”.

“Ms Salian told the court that the confession of Swami Aseemanand pointed to involvement of a right wing group in the Malegaon terror attack. But, the fact that Aseemanand had soon after withdrawn the confession was never brought before the court,” Adv. Prashant Maggu, counsel representing the accused in the case pointed out.

When asked about the procedure for complaint against advocates, Adv. M M Vaidya, who had worked as secretary of the Bar Council for several years said, “Once a complaint is received, the Bar Council generally calls for comments from the advocate complained against. Thereafter the complaint is referred to the disciplinary committee, where proper enquiry is conducted and the advocate may even be debarred from practice.”
