Calcutta High Court rejects PIL seeking removal of Jagdeep Dhankhar as West Bengal governor

Kolkata: Calcutta High Court on Friday dismissed a PIL in removal of Jagdeep Dhankhar from Governor’s post by the Central government.

A division bench comprising Chief Justice Prakash Shrivastava and Justice R Bharadwaj on Friday said that according to Article 361 of the Constitution, the Governor is not answerable to any court.

Petitioner Rama Prasad Sarkar, claimed in the writ petition that Dhankhar is maligning the Trinamool Congress and alleged that the Governor is also interfering in the functioning of the state government.

The petitioner even alleged that the Governor Jagdeep Dhankhar is acting as the ‘mouthpiece’ of the BJP.

It can be recalled that after calling several state government functionaries to get certain queries of his cleared, Governor Dhankhar on Thursday had written a letter to Chief Minister Mamata Banerjee and called her to meet him at Raj Bhawan.

“Hon’ble CM Mamata Banerjee has been urged to make it convenient for an interaction at Raj Bhavan anytime during the week ahead as lack of response to issues flagged has potential to lead to constitutional stalemate which we both are ordained by our oath to avert,” tweeted Dhankhar along with the letter he had written to Mamata Banerjee.

Citing Article 167, which states that the Chief Minister is ‘liable’ to furnish information to the Governor, Dhankhar in his letter stated that his attempts to open dialogue from the state government functionaries didn't materialize for which he had called the Chief Minister to open ‘dialogue’.
